The Law of the Earth

Justice cannot be found in the past. It can only be protected in the present.

Why There Is No Punishment
Upholding the Law pertains
only to stopping crime from occurring,
not to punishing crimes already committed.
Lawful force
is always defensive,
a response to a present event.
And a committed crime
is, by definition, in the past.
Therefore, punishment for a past crime
is, by definition, non-defensive,
and non-defensive force is unlawful.
Nor does punishment deter future crime,
for fear does not eliminate malevolence;
it merely drives it from one place to another.
Thus, punishment has no basis in Law.

Vengeance Is Unlawful
Vengeance is unlawful,
everywhere and always,
no matter who performs it.
Penitence cannot be forced.
Disrespect does not teach respect.
Indignity does not teach dignity.
Domination does not educate.
Fear does not rekindle empathy.
Isolation does not promote pro-social thought.
And the suffering of one
does not restore what was lost by another.
The only reason to take forceful action against someone
is to prevent them from violating the Law.
There is no other lawful reason.

Commentary
VENGEANCE IS UNLAWFUL
These seven lines describe, one by one, every method the present system uses to "correct" people, and why each fails.
We humiliate people and expect them to learn dignity. We isolate them for years and expect them to come back able to live among others. We make them suffer and call that "paying their debt," as though the victim were somehow repaid by someone else's pain. None of it works. All of it is the same instinct, the wish to hurt someone who hurt us, dressed in the language of justice.
The Law of the Earth names that instinct and sets it aside. The only lawful reason to restrain someone is to keep them from harming anyone. Once they no longer would, the reason is gone.

What Truly Reforms
What truly reforms
is not fear, but healing.
The occupation of a penitent
is to practice the Healing Process.
Correction and rehabilitation
come through the restoration
of the person's original spiritual blueprint.
Granted:
someone who commits a crime,
and is impenitent about it,
can be assumed willing to do so again,
and may thus present a danger to others.
And:
dangerous persons may be held in custody
to protect others.
But nevertheless:
such custody may involve no restriction,
pain, or suffering
beyond what is necessary to keep the person secure,
and every feasible means should be used
to facilitate and encourage the Healing Process.

WHAT TRULY REFORMS
No one is born wanting to harm others. Cruelty is learned, usually from cruelty received. A person who does serious harm is, almost always, a person who was seriously harmed, and whose wound was never healed.
That is why the Law speaks of a person's original blueprint: the self they were before the damage. Rehabilitation is not reprogramming someone into a new person. It is helping them return to who they were before they learned to hurt.
Grace doesn't mean leaving dangerous people free. The Law is clear that a person who remains a danger may be held, in the Custodial Village. But it means that the holding is for protection only, and that the time spent there is spent healing. What the Healing Process involves is set out in the Blueprint, at Layer 2: Heal Yourself.

The Meaning of Justice
Justice cannot be found in the past,
and can only be protected in the present.
Reimbursement, restitution, reparation,
and restoration to natural stations of equality
are within the purview of Law,
as they affect the present.
But punishment for punishment's sake
contributes nothing to any good in the present,
and so vengeance has no basis in,
or relevance to, the Law.
169
Commentary
THE MEANING OF JUSTICE
This is not a softening of justice. It is a correction of what the word means.
Justice is the state of things being right, and the only place things can be made right is here, now. A stolen thing can be returned. A damaged forest can be replanted. A person's dignity can be restored. These are just, because they change the present for the better.
A person's suffering in a cell changes nothing for the person they harmed. It adds one more harm to the world and calls the total "justice." The Law of the Earth refuses that arithmetic.

Execution and Sentencing Prohibited
Execution Prohibited
Since execution is, by definition,
the killing of someone already in custody,
its purpose is not to prevent further violations.
The only purpose of execution is vengeance,
and so it is unlawful to perform.
Sentencing Prohibited
Since a sentence is meant to apply to the future,
regardless of the moral development of the person sentenced,
its purpose is not to prevent further violations.
A person could be held despite regaining sanity,
or released despite continued insanity,
and so a sentence has no relation to keeping anyone safe,
and its only purpose is punitive,
and therefore unlawful.
Those in Protective Custody are not "sentenced."
Custody ends
when the Conditions for Release are met.
171
Commentary
EXECUTION AND SENTENCING PROHIBITED
Both arguments are short, because both are airtight.
An executed person was already in custody, and could no longer harm anyone. Killing them prevents nothing. It is pure retribution, and retribution is not defense.
A sentence fails in a subtler way. "Ten years" is a number chosen in a courtroom, about a person no one yet knows how they will change. If the person is healed in two years, the remaining eight are punishment. If they are still dangerous after ten, the release endangers everyone. A sentence is a guess about the future that is guaranteed to be wrong, in one direction or the other. The Law replaces it with a question that can actually be answered: is this person still a danger?

Forgiveness Through Sanity
A person who deliberately violates the Law
is, by definition, insane.
A person who is sane
will not violate the Law.
If a person regains sanity,
there is no further reason to keep them in custody.
The Three Affirmations of Sanity
Acceptance of all three Affirmations
is an uncompromisable criterion for legal sanity,
and so for the right to live among others unsupervised.
1. Everyone is sovereign;
no one owns anyone else;
no one is anyone's property;
no person is a deity over any other;
and no person has the authority to impose
their personal will or desires on others by force.
2. Animals are living beings,
with a capacity to sense and to feel.
3. The health of the ecosystem is paramount;
without it, its importance cannot even be debated,
because there would be no people to debate it.
Any person who denies any of the three Affirmations,
after being presented with them,
has shown themself to be legally insane.
173
Commentary
FORGIVENESS THROUGH SANITY
The Law uses "insane" in a precise sense: out of touch with reality on the questions that matter most for living among others. Someone who believes they own another person, or that animals feel nothing, or that the living Earth doesn't matter, is mistaken about reality in a way that makes them dangerous. That is not an insult. It is a description.
This framing changes everything about what happens next. A person who is sick doesn't need to be punished. They need to get well. And once they are well, there is nothing left to hold them for.
The Three Affirmations are the minimum. They don't ask anyone to accept the whole Law, or any religion, or any party. They ask a person to agree to three facts: that people are free, that animals can feel, and that we depend on the Earth. Anyone who can sincerely agree to these three things can be trusted to live among others.

The Conditions for Release
A person in Protective Custody is released
when all of the following are fulfilled:
1. They affirm the Three Affirmations of Sanity.
2. They can explain why they did what they did,
in a way that makes sense,
though the logic behind it was necessarily flawed.
3. They can explain why it was wrong:
why the Law they broke is true and valid,
why it is necessary,
and why they must follow it from now on.
4. They genuinely understand,
and are not pretending.
5. They provide or promise restitution to their victims,
in full, or as fully as they are able.
6. They no longer constitute a danger to others,
and promise never again to commit the same violation.
175
Commentary
THE CONDITIONS FOR RELEASE
Every condition is something the person can do. None of them is a matter of time served. The door to the Custodial Village is never locked from the inside. It opens the moment the person has walked through the work of understanding what they did.
The second condition may be the most humane. It asks the person to explain their motive in a way that makes sense. Not to justify it, but to understand it. Most people who harm others have never once asked themselves why. Finding the answer is often where healing begins.
Renouncing violence is not a ritual phrase to be recited. It is the undoing of the beliefs that made violence seem acceptable. That is why the fourth condition is there: understanding has to be real. A recited apology opens nothing.

Review of Custody
The council of the community
in which the violation occurred,
and which was affected by it,
must debate the person's release,
with full Rationality,
at least once every:
week – for Class 1 violations
(petty theft, simple assault);
month – for Class 2 violations
(battery, reckless endangerment);
season – for Class 3 violations
(unauthorized ecological degradation, major battery);
year – for Class 4 violations
(homicide, torture, rape,
catastrophic ecological damage).
This is not a requirement to release,
but to debate release.
Debate may be held more often, at any time.
Custody for each class may last
no longer than ten times its review interval,
except for Class 4, which has no maximum.

REVIEW OF CUSTODY
No one disappears into custody under the Law of the Earth. Their case comes back before their own community on a fixed schedule, and their release is argued openly, with the same Rationality used everywhere else in the Law.
The schedule scales with the seriousness of the harm. Someone held for a shoving match is heard every week. Someone held for a killing is heard every year. And for all but the gravest harms, there is an outer limit beyond which custody can't continue. That limit is not a sentence. It is a guarantee to the person held that the community can't simply decide to forget them.

The Great Jubilee
Given that the human race
is emerging from a dark age
of great oppression and ignorance,
it is understandable that many people
now hold a distorted view of law and morality.
Whereas human beings have been
misled, deceived, and bombarded with propaganda,
threatened, traumatized, and divided,
and have had the Law obscured from their vision
from infancy through adulthood,
it is in the interest of the planet
to declare a one-time Global Jubilee.
All Debt Discharged
Every person is offered
a one-time jubilee of total forgiveness,
for all crimes and debts,
financial and karmic, public and private.
When the Jubilee Is Claimed
The Jubilee may be claimed once,
upon first receiving the Law of the Earth,
and formally declaring acknowledgement of it, in public.
The Period It Covers
From the day a person was born,
until the day they were first introduced to the Law.

Commentary
THE GREAT JUBILEE
Almost every person alive today was raised inside a system that taught them the opposite of the Law of the Earth. We were taught that some people may own others, and that land can be bought. We were taught that animals are things, and that force is lawful when a government uses it. We were taught that whatever is legal is right. Nearly all of us have done things, or taken part in things, that the Law would call harm, without ever being told there was another way to see it.
To hold every one of those acts against every person would be impossible, and it would be unjust. Most of it was done in ignorance, under a system designed to keep people ignorant.
So the Law offers a clean slate. Anyone who receives the Law and publicly acknowledges it is released from every debt they carry from the old world. It isn't a reward for agreeing. It is recognition that a person who has just woken up should not be punished for what they did in their sleep. It is also, deliberately, an invitation. It gives all of humanity a powerful reason to acknowledge the Law, and to lay down the grievances that keep us divided.

Custody and Debt
The Jubilee does not release from custody
anyone whose freedom would endanger others.
It frees them from the debts
incurred from and during their insanity.
A person held in Protective Custody
must still fulfill the Conditions for Release,
but the restitution owed for violations
committed before their Jubilee
is discharged.
To Be Forgiven, Forgive
Since the Law includes the Jubilee,
accepting the Law includes forgiving the debts
of others who accept the Law.
After the Jubilee
A person is fully liable
for all debts and violations
incurred after their first introduction to the Law.

Commentary
CUSTODY AND DEBT
Grace isn't naivety. The Jubilee forgives, but it doesn't forget who is still dangerous. A person who would harm others tomorrow is still held today, whatever they did yesterday. What changes is that their past can no longer be used as a weight around their neck.
The forgiveness is mutual, and that is its power. The same person who is released from what they owe is asked to release others from what is owed to them. A world where everyone sets down their old debts at once is a world that can finally begin again.
And from that day forward, everyone knows the Law. No one can claim ignorance afterward, so no one is excused afterward.

Going Forward
All future activities
shall be conducted in a spirit
of mutual cooperation.
Rekindle faith and trust
in the generosity of a healthy society,
and the bounty of the living soil.
Thank you for being sane.

GOING FORWARD
The Law of the Earth ends the way it began, with a single idea seen from the other side. It began with sovereignty: no one owns anyone. It ends with grace: no one is beyond return.
Everything between is the work of living as though both are true.

Commentary
WHY THERE IS NO PUNISHMENT
This is one of the most radical conclusions in the Law of the Earth, and it follows directly from the simplest principle in it. Legitimate Force establishes that the only lawful force is defense, and defense only exists against a present or threatened attack. A crime that is already over is not an attack anymore. There is nothing left to defend against. Force used against its author now can only be revenge.
The second argument is practical. Fear doesn't change what a person wants. It only teaches them to hide it better, or to aim it somewhere else. Every society that has tried to terrify its people into goodness has produced the same result: more cruelty, kept better hidden.
